GENERAL BOOKING TERMS AND CONDITIONS

Reservation and booking of any of our trips included in this programme imply the total acceptance of the following general terms and conditions.

The present terms and conditions are governed by the Royal Legislative Decree (Real Decreto Legislativo) 1/2007 of November 16th, approving the Revised Text of the General Law for the Protection of Consumers and Users and other complementary laws, (BOE 287 November 30th 2007), and all other legal requirements.

The contractual obligations between the organizing Agent and the customer are regulated by the present terms and conditions, by the particular clauses which are agreed upon in the package travel contract and by the travel itinerary which contains all the details.

The customer is obliged to check all documentation received from the Agent, and any questions concerning this must be notified before the start of the trip.

ORGANIZATION: The trips included in this programme have been organised by MIGUEL ANGEL GOMEZ RODRIGUEZ, NIF: 71211874-X with registered office in Paseo de la Estación nº8, 7º izquierda Peñaranda de Bracamonte 37300 (Salamanca). An Online Travel Agency which is registered with the Tourist Office of Castilla y León, with licence number CICL.37-093.

The Agent has obligatory Public Liability Insurance and is endorsed by Public Administration.

BOOKING AND ADMINISTRATION: Services included are detailed in each section. In the event of a change in the trip by any of the parts, the services included or not included will be detailed in the contract agreement. At the time of booking, the customer will pay a non-refundable deposit of 20% of the trip to cover administration costs. Once the reservation has been confirmed, the deposit fee will be discounted from the final price of the trip. If the Agent cannot offer the trip requested, the deposit will be refunded. Once all the trip information and itinerary has been sent, the reservation fee deposited cannot be refunded.

PAYMENT METHOD: The total payment will be made by the customer at least 7 days before the departure date. If the payment is not made, the Agent will assume that the customer no longer requires the trip thereby forfeiting the deposit paid.

RESERVATION ALTERATIONS: Any kind of modification to the trip on the part of MIGUEL ANGEL GOMEZ RODRIGUEZ, for various reasons such as overbooking, etc.., will be notified to the customer who will be able to accept or cancel the trip. If the customer cancels, the Agent will not penalize them. If the modifications are due to the customer’s requirements, MIGUEL ANGEL GOMEZ RODRIGUEZ reserves the right to demand a payment of 30€ per customer and alteration.

CANCELLATION ON THE PART OF THE CUSTOMER: The customer may cancel the services at any time with the right to a refund of part of the amount paid, indemnifying the Agent, except in the case of force majeure, according to the following: a) Cancellation between 10 and 15 days before the start of the trip, the client will pay the administration booking fee and a penalty of 5% of the total cost; b) Cancellation between 3 and 10 days before the start of the trip: 15%, and c) Cancellation within 48 hours before departure: 25%.

If the customer does not appear on the day of departure, they will be obliged to pay 100% of the total cost of the trip.

In the event of the Agent having to cancel some of its programmes for reasons not attributable to the customer, it will refund the customer the total amounts paid towards the programme.

There is no obligation on the part of the Agent to indemnify the customer when the cancellation of the programme is due to force majeure, or similar reasons. This refers to unforeseeable circumstances whose consequences were unavoidable despite having acted with due diligence.

In the event of a trip being subject to a minimum number of participants and is so specified, the Agent can cancel the trip if the minimum number is not attained, giving a minimum of 10 day’s notification before the departure date.

TRANSFERING THE RESERVE: The principal contractor or beneficiary may transfer the reservation free of charge to a person who meets all the conditions required for such, sending written notification at least 15 days before the start date of the journey. The person who transfers their reservation and the transferee will settle between them the remainder of the cost to the Agent, as well as additional costs which may have been generated by the transfer.

DOCUMENTATION: All persons subscribing to the trip are responsible for bringing the necessary documentation for the country they are visiting (National Identity Card, Passport, Visa, Health certificates etc.). Regarding inquiries, the Agent will do its best to inform, but it is the customer’s responsibility to confirm the information with the competent authorities. In the event of the costumer having to cancel or abandon the trip due to lack of or irregular documentation, the Agency will apply the conditions mentioned above in the paragraph on cancellation on the part of the customer.

JURISDICTION: Interpretations, applications or claims on behalf of either the customer or the Organizing Agent shall be submitted exclusively to the courts of Salamanca and to no other court.

DATA PROTECTION ACT (LOPD): In compliance with the Spanish law 15/1999 for the Protection of Personal Data this establishment declares that:

1. Our customer’s personal details are incorporated onto a private file registered with the Spanish Agency for Data Protection, and are the responsibility of MIGUEL ANGEL GOMEZ RODRIGUEZ.

2. We guarantee confidentiality of all personal details registered on our files.

3. We have a security document which includes technical and organizational measures to ensure the security of the data on our files.
